(A) The client gives CDMS, its employees, contractors, subcontractors and agents permission to be on/in the property listed on this document, to take photos and record videos, and to disseminate the material to the listed real estate agency/agent; (B) The Client acknowledges that CDMS has exclusive rights to ownership of the copyright in all images, videos and other materials created and shall have the exclusive, transferrable, sub-licensable, royalty-free, worldwide license to make reproductions, post on social media, use in promotional material, and use on the Internet or other means that exist or may exist in the future. The Client acknowledges that CDMS may use the material in a reasonable way without any further permission outside of this form. The Client may use the materials delivered on the Internet, social media, television, radio, or other mediums in an effort to sell/rent their property. The named real estate agent/agency may use the materials delivered on the Internet, social media, television, radio, or other mediums in an effort to sell/rent the state property or to promote his/her business; (C) The Client does not hold CDMS liable for any damages or loss of property that occurs during the operation that is not a direct result of negligence or gross or willful misconduct by CDMS; (D) CDMS will do its best to accommodate all requests from the Client, but CDMS has the editorial freedom to change, alter, add to and subtract from plans based on safety, ability, technological limitations, weather and other factors; (E) The Client understands that CDMS must follow all federal, state and local laws and regulations as it pertains to the operation of a drone (if applicable); (F) The Client understands that planned operations may have to be canceled, rescheduled or suspended in the event of inclement weather or other Act of God, including but not limited to fire, rain, snow, thunder, lightning, wind, and temperatures that are too high or too low for safe operation; (G) CDMS reserves the right to cancel, suspend or postpone any operation in the event it determines conditions are unacceptable or unsafe; (H) The Client affirms they have the legal authority to grant CDMS, its employees, contractors, subcontractors and agents permission to access the property. I HEREBY CERTIFY THAT ALL THE INFORMATION ABOVE IS TRUE TO THE BEST OF MY KNOWLEDGE AND THAT I HAVE READ AND UNDERSTAND ALL RELEVANT INFORMATION, TERMS AND STIPULATIONS.
